Not truthfully.  CART is a trademark of commercial software.  rpart (sic) 
is similar but not 'modified' from anything -- it is an independent 
implementation of the ideas in Breiman, Friedman, Olshen and Stone (with 
some extra ideas by Terry Therneau and others).

party (sic) is very much more general than CHAID.
