You don't say which version of emacs you are running. I am on

"GNU Emacs 24.1.1 (x86_64-apple-darwin, NS apple-appkit-1038.36) of
2012-06-10 on bob.porkrind.org"

I have had other issues but not the one you seem to be getting.

I would try using the emacs package manager (although I think ess came
bundled with my current emacs).

Further, I installed a new emacs about 4 weeks ago which I haven't
used much. I just now used the package manager with it to install
ess. The new version looks really good. You probably don't need to
live quite so dangerously though.
